I have observed such non-flat tyrosines before too in a
serine protease structure at 1.5 A resolution, for which
the data were collected on local x-ray. I think it might
be the nature of protein structure at high resolution, or
environment dependent. However, I didn't treat them
specifically because I was not sure if they are chemically 
valid.
